 ND BOARD OF NURSING BYLAWS

ARTICLE 1  NAME

 The board is known as the North Dakota Board of Nursing.

ARTICLE II AUTHORITY

 The authority is North Dakota Century Code 43.12.1.  It is the intent of this board that it shall be governed by all the laws of the state of North Dakota.

ARTICLE III  MISSION

 The mission of the North Dakota Board of Nursing is to assure North Dakota citizens quality nursing care through the regulation of standards for nursing education, licensure, and practice.

ARTICLE IV MEMBERSHIP

 Section 1: Members

 The North Dakota Board of Nursing shall consist of five registered nurses, three licensed practical nurses, and one public member, appointed by the governor. Each member of the board shall hold office until his successor is appointed.

 Section 2: Qualifications

 Appointments shall be made by the governor from nominations submitted by any interested citizen of North Dakota. Such person shall have the following qualifications:

 1.   Each registered nurse must be an eligible voting resident in this state, possess an unencumbered registered nurse license under this chapter, and be currently engaged in practice as a registered nurse.  A majority of the members under this subsection must be actively engaged in practice in a nurse-patient setting.

 2.  Each licensed practical nurse must be an eligible voting resident in this state, possess an unencumbered practical nurse license under this chapter, and be currently engaged in practice as a licensed practical nurse.  A majority of the members under this subsection must be actively engaged in practice in a nurse-patient setting.

3.  Each public member must be an eligible voting resident in this state and have no employment,  professional license, or financial interest with any health care entity.

4.  Each member appointed to the board shall maintain the qualifications for appointment for  the  duration of the appointment. The governor may remove any member of the board for cause  upon recommendation of two-thirds of the members of the board.

 Section 3: Terms

 The members will serve four year terms. No appointee may be appointed for more than two consecutive terms.

 Section 4: Vacancies on board.

 Vacancies on the board shall be filled by appointment by the governor for the remainder of the unexpired term. An appointment for an unexpired term of more than eighteen months shall constitute a full term.

 Section 5: Compensation.

 A member of the board is entitled to receive compensation in an amount fixed by the board for each day or portion of a day the member is actually engaged in the performance of official duties and such mileage reimbursement as is provided for in section 54-06-09. In addition the member is entitled to reimbursement for actual and necessary expenses in the amounts provided by law for state officers in section 44-08-04.


ARTICLE V MEETINGS OF THE BOARD

 Section 1:  Regular Meetings

 Meetings of the North Dakota Board of Nursing shall conform to North Dakota law regarding open meetings.  The regular meetings of the Board shall be held on the third Thursday and Friday, bimonthly, in January, March, May, July, September, and November unless otherwise ordered by the Board.

 Section 2: Annual Meeting

 The regular meeting in July shall be known as the annual meeting and shall be for the purpose of election of officers, receiving reports of officers and committees, and for any other business that may arise.  The annual meeting shall be conducted by the ranking officer of the prior fiscal year.

 Section 3: Special Meetings

 Special meetings may be called by the President, the Executive Committee, or upon written request of four Board members.  The purpose of the meeting shall be stated in the call.  Except in cases of emergency, at least three days notice shall be given.

 Section 4: Quorum

 Five Board members which includes the presiding officer shall constitute a quorum.

ARTICLE VI OFFICERS

 Section 1:  Offices

 The officers of the Board shall be President, Vice President, and Treasurer.

 Section 2:  Election

 The officers shall be elected by ballot to serve for one year or until their successors are elected, and their term shall begin at the close of the annual meeting at which they are elected.

 Section 3: Limitations

 No member shall hold more than one office at a time and no member shall be eligible to serve more than two consecutive terms in the same office.

 Section 4: Vacancies

 Vacancies in any office other than that of president shall be filled by temporary appointment by the president from members of the board. Such persons shall discharge all the duties of the office until the next regular meeting of the board, at which time the board shall elect a member to fill such vacancies for the unexpired term. If a vacancy occurs in the office of president, then the vice-president shall become the president pro tem of the board until the next meeting of the board. The board shall then elect a president for the unexpired term.

ARTICLE VII DUTIES OF THE OFFICERS

 Section 1:  President

 The president shall preside at all meetings of the board and perform such other duties applicable to the office. The president shall appoint special committees as deemed necessary by board action. 

 Section 2: Vice President

 The vice president shall serve as chair of the strategic planning committee, and during the absence or disability of the president, assume all the duties and privileges of the president and perform such other duties applicable to the office.
 

 Section 3: Treasurer

 The treasurer shall serve as chair of the finance committee, review board expenses, and perform such other duties applicable to the office.

ARTICLE VIII COMMITTEES

 All committee meetings shall conform to the North Dakota law regarding open meetings. The dates, times, and places of all committee meetings shall be on file at the board office.

 Membership on standing committees shall be appointed by the President and members of the Board of Nursing during the annual meeting. Appropriate board staff shall serve as non-voting members of all committees. Board staff or designates shall provide support services to each committee, and prepare and distribute minutes of each meeting to committee members.

 Section 1: Executive Committee

 The executive committee shall consist of the duly elected officers of the board. The executive committee shall provide direction and guidance to the executive director in between board meetings when appropriate, shall compile yearly evaluations of the executive director, review and make recommendations on strategic plans of the board and conduct a yearly review of the bylaws.

 Section 2: Prescriptive Authority Committee

 The prescriptive authority committee shall be composed of four members.  The board of medical examiners and the board of pharmacy shall each appoint one member.  The board shall appoint two members, at least one of whom must be a registered nurse board member and one shall be an advanced practice registered nurse with prescriptive authority.  The committee will meet at least once each year to review rules for prescriptive authority; oversee the process of granting prescriptive authority; and recommend changes to the board.

 Section 3: Nursing Education Committee

 The nursing education committee shall be composed of at least three board members. The purpose of this committee is to make recommendations related to nursing education.  The committee shall make recommendations for awarding nursing education loans to a qualified applicant admitted to a basic nursing education program or a program to complete studies in a graduate degree or a specialty program in nursing or a refresher course. Any board member or staff applicant for a nursing education loan shall not participate in making loan applicant recommendations.

 Section 4: Finance Committee

 The finance committee shall be composed of the treasurer and two board members. The committee shall be charged with overseeing investments and management of board funds and make recommendations to the board for an annual operating budget.

 Section 5:  Program Monitoring Committee

 The program monitoring committee shall be composed of three board members. The purpose of the committee is to make recommendations regarding disciplinary and non-disciplinary processes. 

 Section 6:  Nursing Practice Committee
 The nursing practice committee shall be composed of two board members and representatives of the nursing community.  The committee shall provide guidance and direction on rule revision and nursing practice related issues. 

 Section 7:  Other Committees

 Such other committees, standing or special, shall be appointed by the President as the Board or the Executive Committee shall from time to time deem necessary to carry on the work of the Board.

 

ARTICLE IX RULES OF CONDUCT

 The board shall use the current edition of Robert's Rules of Order Newly Revised for parliamentary procedure.


ARTICLE X AMENDMENTS

 These bylaws may be amended at any regular meeting of the Board by a two-thirds vote provided that the amendment has been submitted in writing at least five days prior to that meeting and provided the amendment does not conflict with any provision of the Act creating the Board, subsequent amendment to the Act, or with any rules of the Board.

ARTICLE XI FISCAL YEAR

 The fiscal year of the board shall correspond with the fiscal year of the state of North Dakota.
